S.I. No. 134 of 2016: Immigration Act 1999 (Deportation) (Amendment) Regulations 2016


S.I. No. 134 of 2016

These Regulations came into force on 10 March 2016. The Regulations amended Regulation  5 of the Immigration Act 1999 (Deportation) Regulations 2005 (S.I. No.55 of 2005) by substituting “section 5(3)” for “section 5(1)”.

The Regulations also inserted a new Regulation 7 into the 2005 Regulations, to provide that a person who has been arrested under section 5(1) or (2) of the Immigration Act 1999 may, for the purposes of his or her detention in a prescribed place, be taken by an immigration officer or member of An Garda Síochána to a prescribed place and be detained there until further notice under warrant of the immigration officer or member of An Garda Síochána who arrested him or her.
