On 1 February 2016 the European Communities (Free Movement of Persons) Regulations 2015 (S.I. No.548 of 2015) came into force. Subject to the transitional provisions in regulation 31, the 2006 Regulations are revoked by the 2015 Regulations.
The Regulations provide for
- permission for Union citizens and qualifying family members to enter the State (regulation 4),
- permission for permitted family members to enter State (regulation 5),
- residence in the State (regulation 6),
- residence cards for family members who are not nationals of a Member State (regulation 7),
- validity of residence card (regulation 8),
- retention of the right of residence by family members in the event of death or departure from the State of Union citizen (regulation 9),
- retention of the right of residence by family members in the event of divorce, annulment of marriage, annulment or dissolution of civil partnership (regulation 10),
- retention of rights of residence (regulation 11),
- entitlement to permanent residence in the State (regulation 12),
- entitlement to permanent residence in the State of Union citizen no longer working in the State and his or her family members (regulation 13),
- the issue of permanent residence certificates to Union citizens (regulation 14),
- the issue of permanent residence cards to family members who are not nationals of a Member State (regulation 15),
- production of evidence (regulation 16),
- entitlements and matters of equal treatment (regulation 17),
- restrictions on the right of freedom of movement and residence on grounds of public policy and public security (regulation 18),
- restrictions on the right of freedom of movement and residence on grounds of public health (regulation 19),
- removal orders (regulations 20-21),
- arrest and detention for purposes of removal from the State (regulation 22),
